Kibcab Terms of Service

1.1. Contractual Relationship

These Terms of Use (“Terms”) govern the access or use by you, an individual, of applications, websites, content, products, and services (the “Services”) made available by Cylink Software and Technology Services Ltd. (“KIBCAB app”) a private limited liability company established in TRNC. Your access and use of the Services constitutes your agreement to be bound by these Terms, which establishes a contractual relationship between you and KIBCAB. If you do not agree to these Terms, you may not access or use the Services. These Terms expressly supersede prior agreements or arrangements with you. KIBCAP may immediately terminate these Terms or any Services with respect to you, or generally cease offering or deny access to the Services or any portion thereof, at any time for any reason. Supplemental terms may apply to certain Services, such as policies for a particular event, activity or promotion, and such supplemental terms will be disclosed to you in connection with the applicable Services. Supplemental terms are in addition to, and shall be deemed a part of, the Terms for the purposes of the applicable Services. Supplemental terms shall prevail over these Terms in the event of a conflict with respect to the applicable Services. KIBCAB may amend the Terms related to the Services from time to time. Amendments will be effective upon KIBCAB’s posting of such updated Terms at this location or the amended policies or supplemental terms on the applicable Service. Your continued access or use of the Services after such posting constitutes your consent to be bound by the Terms, as amended. Our collection and use of personal information in connection with the Services is as provided in KIBCAB’s Privacy Policy located at 

kibcab.com. KIBCAB may provide to claim processor or an insurer any necessary information (including your contact information) if there is a complaint, dispute or conflict, which may include an accident, involving you and a Third Party Provider (including a transportation network company driver) and such information or data is necessary to resolve the complaint, dispute or conflict.

 

1.2. Thank you for using Kibcab. These Terms of Service ("Terms") govern your use of the Application, so please read them carefully before proceeding. By accessing or using the Application, you agree to be bound by these Terms. If you do not agree to these Terms, please refrain from using the Application.

 

Application Use

2.1. The Application allows users to request taxi services provided by independent third-party drivers. The Application serves as a platform to facilitate the connection between users and drivers. 

 

2.2. You understand and agree that the Application is not responsible for the actions or omissions of the drivers. The drivers are independent contractors, and the Application does not control the quality, reliability, or legality of their services.

 

2.3. The Application reserves the right to refuse service to anyone, at any time, without providing a reason.

User Responsibilities

3.1. You agree to provide accurate and complete information when using the Application, including your name, contact details, and pickup/drop-off location.

 

3.2. You agree not to use the Application for any unlawful or unauthorized purposes. You will comply with all applicable laws and regulations while using the Application.

 

3.3. You are solely responsible for any interactions, negotiations, and agreements made with drivers through the Application. The Application is not liable for any disputes, damages, or losses arising from such interactions.

The Service is not available for use by persons under the age of 18. You may not authorize third parties to use your Account, and you may not allow persons under the age of 18 to receive transportation or logistics services from Third Party Providers unless they are accompanied by you. You may not assign or otherwise transfer your Account to any other person or entity. You agree to comply with all applicable laws when using the Services, and you may only use the Services for lawful purposes (e.g., no transport of unlawful or hazardous materials). You will not, in your use of the Services, cause nuisance, annoyance, inconvenience, or property damage, whether to the Third Party Provider or any other party. In certain instances you may be asked to provide proof of identity to access or use the Services, and you agree that you may be denied access to or use of the Services if you refuse to provide proof of identity.

 

Fare Calculation and Payment

4.1. The fare for the taxi services is calculated based on factors such as distance, time, and any applicable surcharges. The Application provides an estimate of the fare, but the final fare may vary due to factors beyond our control.

 

4.2. You agree to pay the fare for the services rendered through the Application. The payment can be made using the available payment methods provided in the Application.

 

4.3. The Application may charge additional fees for cancellation, no-show, or other applicable charges. These fees will be clearly communicated to you before confirming your request.

 

Intellectual Property

5.1. The Application and its content, including but not limited to logos, trademarks, text, graphics, images, and software, are the intellectual property of the Application owner. You agree not to modify, distribute, reproduce, or create derivative works based on such content without explicit permission.

 

Limitation of Liability

6.1. To the maximum extent permitted by law, the Application and its owners, directors, employees, and affiliates shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of the Application, including but not limited to any errors, inaccuracies, or interruptions in the services provided.

 

Governing Law and Dispute Resolution

7.1. These Terms shall be governed by and construed in accordance with the laws of the Turkish Republic of Northern Cyprus. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of the Turkish Republic of Northern Cyprus.

 

Modifications to the Terms

8.1. The Application reserves the right to modify or update these Terms at any time without prior notice. You are responsible for reviewing the most current version of the Terms before using the Application.

 

Severability

9.1. If any provision of these Terms is held to be invalid or unenforceable, such provision shall be severed from the Terms, and the remaining provisions shall continue to be valid and enforceable.

 

Text Messaging.

10.1. By creating an Account, you agree that the Services may send you informational text (SMS) messages as part of the normal business operation of your use of the Services. You may opt-out of receiving text (SMS) messages from us at any time by sending an email to service@kibcab.com indicating that you no longer wish to receive such messages, along with the phone number of the mobile device receiving the messages. You acknowledge that opting out of receiving text (SMS) messages may impact your use of the Services.
